Frequently Ask Question

A parenting order is a legally binding court order that defines how parental responsibilities, time with children, and communication should be shared after separation. It is required when the parents cannot agree on arrangements themselves or via mediation.

A parenting plan is a non-binding agreement between parents about arrangements for children (living arrangements, communication, etc.). A consent order is a binding court order formally approved by a judge, enforcing what the parents agree upon.

You must notify and often seek permission (via variation of the order or court approval) before relocating with your child if it significantly affects the existing arrangements.

You may apply to the court to have the order enforced, varied, or for other remedies. Breach of court orders can lead to penalties or other court interventions.

The court considers various factors: the child’s views (depending on age), their relationship with each parent, the ability of each parent to provide for the child, and any history of family violence or abuse.
